La Porte adopted the 2024 International Swimming Pool and Spa Code by Ordinance No. 2025-4094 on August 11, 2025, and its code says the pool code controls "the design, construction, alteration, movement, renovation, replacement, repair and maintenance" of pools, spas and hot tubs. The 2024 residential and building codes came in by Ordinance No. 2024-4026 on December 9, 2024.

On the City's fee schedule, "All other building permits for residential use" cost $10.00 each, a group that names repair, replacement and swimming pools alongside fences, roofs, patios and driveways; structures over 250 square feet pay $15.00 or $25.00 plus $0.39 a square foot, and work started without a required permit pays double. The schedule leaves open which line a pool job falls under, so ask the City's Inspection Services which permit and fee a resurfacing takes.

A house exemption that doesn't reach pool tile

La Porte's amendment to the residential code exempts "Painting, papering, tiling, carpeting, cabinets, counter tops and similar finish work" from permits, along with prefabricated pools less than 24 inches deep. That list is written for houses. Pool renovation and repair sit under the separate pool code, so the house "tiling" line doesn't cover pool tile or plaster.

Fences and setbacks

Under La Porte's zoning, pools, spas and hot tubs are enclosed by a fence at least four feet high that meets the adopted pool code. Pools sit at least 5 feet from side and rear lot lines, 3 feet from a utility easement and 6 feet from neighboring structures, or 3 feet with a licensed engineer's letter; spas sit 5 feet from side and rear lines, and decks and pool pumps, filters and heaters sit 2 feet from them and never in a utility easement. La Porte's amendment to the pool code says wastewater from pools or spas, such as backwash water from filter discharges, drains to a building drainage system through an air gap, and deck drains tied to a building drain need an air gap as well. The City's storm sewer ordinance bars any discharge into the storm system that isn't entirely stormwater, and it names dechlorinated pool water among the discharges that can be raised as a defense, so the chlorine comes out of a drained pool's water first. What rules does La Porte set for public pool water?

It is unlawful in La Porte to run a public swimming pool without a public pool license from the City's inspection services division.
